By accessing or using BidTrakker (the "Service"), available at fedtrakker.app, you agree to be bound by these Terms of Service ("Terms"). The Service is owned and operated by GCExperts LLC, located at 300 Brushy Creek Rd, Ste 404, Cedar Park, TX 78613. If you do not agree to these Terms, you must not access or use the Service.
Access to BidTrakker requires an active, paid membership with GCExperts LLC. Your membership status is verified through our payment processor, Stripe. If your membership lapses, is canceled, or is otherwise inactive, your access to BidTrakker will be suspended until membership is restored.
BidTrakker provides aggregated federal construction contract opportunity data sourced from the System for Award Management (SAM.gov), operated by the U.S. General Services Administration. The Service includes:
While we strive to provide accurate and timely data, GCExperts LLC makes no warranties or representations regarding the accuracy, completeness, reliability, or timeliness of any contract opportunity data presented through BidTrakker. Data is sourced from SAM.gov and other federal databases, which may contain errors, omissions, or delays.
You are solely responsible for independently verifying all bid information, deadlines, requirements, and eligibility criteria before submitting any bid or proposal to a federal agency.
The BidTrakker Sync Client software is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, whether express, implied, or statutory. GCExperts LLC does not guarantee that the Sync Client will be uninterrupted, error-free, or compatible with all systems. You assume all risk associated with installation and use of the Sync Client.
The BidTrakker Sync Client may, from time to time, display notifications, surveys, product updates, service announcements, or other communications from GCExperts LLC. These communications may open in your default web browser or appear as system notifications. By installing and using the Sync Client, you consent to receiving these communications as part of the service. You may opt out of non-essential communications by uninstalling the Sync Client at any time.
You are responsible for maintaining the confidentiality of your account credentials. Specific obligations include:
GCExperts LLC reserves the right to suspend or terminate your access to BidTrakker at any time, with or without notice, for reasons including but not limited to:
Upon termination, your right to access the Service ceases immediately. GCExperts LLC shall not be liable for any damages arising from termination of your account.
All content, features, functionality, software, designs, text, graphics, and trademarks associated with BidTrakker are the exclusive property of GCExperts LLC or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any portion of the Service without prior written consent from GCExperts LLC. Federal contract opportunity data sourced from SAM.gov remains in the public domain as provided by the U.S. government; however, our presentation, organization, and enhancement of that data is proprietary.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GCEXPERTS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
IN NO EVENT SHALL GCEXPERTS LLC'S TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID FOR YOUR MEMBERSHIP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless GCExperts LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
GCExperts LLC reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of BidTrakker after any modification constitutes acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify you via email or through the Service.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Williamson County, Texas, and you consent to the personal jurisdiction of such courts.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and GCExperts LLC regarding your use of BidTrakker and supersede all prior agreements and understandings.
